DISCLAIMER
FundAnyone reserves the right to decline or remove any proposed or active Fundraising Project and its contents at anytime at our sole discretion. FundAnyone also reserves the right to delete any user or member account at anytime at our discretion without explanation.
SAFETY
FundAnyone takes your safety very seriously. We have taken countless measures to ensure a positive fundraising experience for both FundAnyone Fundraisers and Donors alike. FundAnyone expects all Users to provide authenticity and transparency regardless of whether they are donating or creating a Fundraising Project. To protect all involved, Users should never provide any personal contact information, such as phone number or mailing address, to any unknown entity that requests it. Donors should only contribute payments to FundAnyone Fundraisers they personally know and trust. Unfortunately there is no way to guarantee that a FundAnyone Fundraising Project page contains accurate or truthful information. As such, Donors should not make payments to any projects or people unless they fully understand and trust the cause presented. Further, beware of donation pages that attempt to bypass the preferred donation method (i.e., posting direct links to alternative payment methods). Attempting to bypass the preferred donation method is strictly prohibited by FundAnyone and will result in account termination. All donations should only be made by clicking the ‘SUPPORT NOW’ button on the FundAnyone Fundraising Project page. If any pages request direct payment or Fundraisers attempt to contact you to arrange an alternative method of payment, please notify FundAnyone immediately.

SECURITY
FundAnyone takes your security very seriously. FundAnyone uses Stripe payment services to process all donations. Each FundAnyone Fundraising Project will receive all donated funds into the chosen bank account listed on the Fundraiser’s Stripe Account. At no time will FundAnyone store or distribute any sensitive data such as Users’ banking information or passwords to payment accounts. Users will securely provide such information only within use of the website during Project setup or when prompted by the Stripe payment processing service. All transactions initiated through FundAnyone are securely encrypted using Secure Sockets Layer (SSL) technology. A small security indicator, usually a lock icon or green bar, will appear in the web browser you’re using to verify the security of the transaction. As for Stripe, transaction processing security is their biggest concern and they take extreme measures to ensure secure transactions. Stripe has been audited and certified as a PCI Service Provider Level 1, the most stringent level of certification, which means the highest level of security and protection possible. COMPLIANCE
- By using the FundAnyone website for any reason, you warrant and agree:
- The funds raised through FundAnyone will be used solely for the purposes you describe.
- To comply with all federal, state and local laws applicable to you.
- To comply with the Privacy Policy and Terms and Conditions.
- All information provided to FundAnyone is truthful, you are not impersonating anyone and you are honest as to any affiliation with any person or entity.
FundAnyone is not responsible for any error or omission in the information provided by any Fundraiser or Donor.
COMMUNICATIONS
You agree that FundAnyone may communicate electronically with you, by sending communications to the provided email address, and that FundAnyone is not liable for any User generated content that is emailed to you as part of such communications. It is understood and agreed that you are liable for all communications you send promoting your FundAnyone Fundraising Project.
PROHIBITED ACTIVITIES
FundAnyone may not be used for activities that violate any law; federal, state or local. Without limiting the aforesaid general prohibition, you may not use FundAnyone for any activity related to (a) items that encourage, promote, facilitate or instruct others to engage in illegal activity, (b) items that promote hate, violence, racial intolerance, or the financial exploitation of a crime, (c) items that infringe or violate any copyright, trademark, right of publicity or privacy or any other proprietary right under the laws of any jurisdiction, (d) cause risk of injury to any person or damage to any tangible or intangible property, (e) self-promotion beyond actions authorized by FundAnyone, or (f) harassment, stalking, bullying or cyber-bullying.
REFUNDS
There are no refunds, for any reason, except for special circumstances deemed reasonable by FundAnyone (i.e., donation made using a stolen credit card). Donors assume the full risk of investigating and determining whether to donate. Under certain circumstances FundAnyone may, but is under no obligation to, seek the refund of Project funding if a Fundraiser misrepresents the Project or misuses the funds. You acknowledge and agree that all donations are between the Donor, the Fundraiser, and the payment processing service only, and that FundAnyone is not responsible for any donations or transactions, including without limitation any personal or payment information you provide to the payment processing service. You agree that FundAnyone has the right, but not the obligation, at its sole discretion, to delay funding, withhold funding, reverse funding or otherwise refund money to Donors.
TAXES
It is understood and agreed that: (a) you will not hold FundAnyone liable or responsible for any funds or tax obligations on donated or received funds or those funds paid to 3rd-party payment services, (b) FundAnyone makes no representations regarding the deductibility of any donations or received funds for tax purposes, and (c) FundAnyone cannot be held responsible in any tax matter related to your use of FundAnyone.
LITIGATION
It is understood by all website Users that FundAnyone cannot be held liable for or be involved in any litigation that occurs due to any Users’ actions or misrepresentations in relation to FundAnyone or their use of this website.
NO LEGAL ADVICE
No content on FundAnyone; including but not limited to, the Legal page, our Privacy Policy or the Terms and Conditions constitutes legal advice. If you have any questions regarding your legal rights and legal obligations, you should consult with your own attorney.
WAIVERS OF LIABILITY
FUNDANYONE MAKES NO PROMISES, REPRESENTATIONS OR WARRANTIES AS TO THE MERCHANTABILITY OF ITS SERVICES OR FITNESS OF ITS SERVICES FOR ANY PARTICULAR PURPOSE. IT IS UNDERSTOOD AND AGREED THAT YOU RELEASE AND HOLD HARMLESS FUNDANYONE FROM ANY AND ALL LIABILITY THAT FUNDANYONE MAY OTHERWISE HAVE WITH REGARD TO OR ARISING FROM THIS AGREEMENT OR ANY SERVICES PROVIDED BY FUNDANYONE, FOR REASONS INCLUDING, BUT NOT LIMITED TO, DELAY OR FAILURE OF FUNDANYONE SERVICE, NEGLIGENCE, OR ANY OTHER TORT OR BASIS FOR CIVIL LIABILITY. IF THERE IS ANY APPLICABLE LAW THAT RESTRICTS SUCH RELEASE OF LIABILITY, IT IS AGREED AND UNDERSTOOD THAT FUNDANYONE IS ONLY LIABLE FOR THE MINIMUM AMOUNT OF DAMAGES THAT THE LAW RESTRICTS FUNDANYONE’S LIABILITY TO, IN THE EVENT THAT SUCH A MINIMUM EXISTS.
IT IS AGREED AND UNDERSTOOD THAT FUNDANYONE IS NOT RESPONSIBLE IN ANY WAY FOR PROMISES, REPRESENTATIONS OR ANY OTHER STATEMENTS MADE BY THIRD PARTIES ON OR THROUGH THE FUNDANYONE WEBSITE, OR BY ANY OTHER MEANS OF COMMMUNICATION TO YOU, NOR IS FUNDANYONE RESPONSIBLE FOR ANY BREACH OF WARRANTY OR SUBSTANTIALLY SIMILAR CLAIM ARISING FROM ANY GOODS OR SERVICES OBTAINED OR PROCURED THROUGH FUNDANYONE. FUNDANYONE BEARS NO RESPONSIBILITY FOR ANY THIRD PARTY CLAIMS OR REPRESENTATIONS THAT ARE MADE IN BAD FAITH, FRAUDULENTLY OR NEGLIGENTLY, INCLUDING BUT NOT LIMITED TO CLAIMS OR REPRESENTATIONS CONCERNING CHARITABLE SOLICITATIONS, WHETHER OR NOT SUCH CHARITABLE SOLICITATIONS ARE MADE IN CONNECTION WITH A TAX-EXEMPT ENTITY.
FUNDANYONE ASSUMES NO RESPONSIBILITY FOR FAILURES OR ERRORS COMMITTED BY OR THROUGH ANY THIRD PARTY PAYMENT PROCESSORS. FUNDANYONE SHALL NOT BE RESPONSIBLE FOR OR OTHERWISE LIABLE FOR ANY FAILURE OF THE GOODS OR SERVICES OF FUNDANYONE OR ANY THIRD PARTY, INCLUDING BUT NOT LIMITED TO ANY INTERNET OUTAGES, FAILURES OR DISRUPTIONS IN SERVICES, UNTIMELY DELIVERY, WHETHER OR NOT SCHEDULED, WHETHER OR NOT INTENTIONAL, AND WHETHER TEMPORARY OR PERMANENT.
YOUR USE OF FUNDANYONE CONSTITUTES YOUR AGREEMENT WITH AND YOUR PROMISE TO COMPLY WITH FUNDANYONE’S LEGAL DISCLAIMERS, PRIVACY POLICY AND TERMS AND CONDITIONS INCLUDING BUT NOT LIMITED TO THESE WAIVERS OF LIABILITY. FUNDANYONE’S PROVISION OF ANY SERVICES TO YOU IS CONTINGENT ON YOUR AGREEMENT WITH THIS AND ALL OTHER SECTIONS OF THIS AGREEMENT. NOTHING IN THE SPECIFIC PROVISIONS OF THESE TERMS OF USE SHALL BE CONSTRUED TO LIMIT THE GENERALITY OF ANY OF THE PROVISIONS OF THESE TERMS OF USE.
The following applies only to the extent that these Terms of Use are controlled by the laws of a Jurisdiction that prohibit the limitations on liability set forth above to any extent: Notwithstanding any provision of these Terms, if these Terms of Use are subject to a jurisdiction that has provisions specific to waiver or liability that are in conflict with the above, then FundAnyone’s liability is limited so that its liability is the smallest and most limited possible by law.
IF YOU ARE A RESIDENT OF A JURISDICTION THAT REQUIRES A SPECIFIC STATEMENT REGARDING RELEASE THEN THE FOLLOWING APPLIES. FOR EXAMPLE, CALIFORNIA RESIDENTS MUST, AS A CONDITION OF THIS AGREEMENT, WAIVE THE APPLICABILITY OF CALIFORNIA CIVIL CODE SECTION 1542, WHICH STATES, “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.” YOU HEREBY WAIVE THIS SECTION OF THE CALIFORNIA CIVIL CODE. YOU HEREBY WAIVE ANY SIMILAR PROVISION IN LAW, REGULATION, OR CODE THAT HAS THE SAME INTENT OR EFFECT AS THE ABOVE RELEASE.
